Terms and Conditions

            Welcome to Mosmos, a platform operated by Asenatech
                Limited, a
                company registered in Kenya and headquartered in Nairobi. These Terms and Conditions (“Terms”) govern
                your use of the Mosmos website, mobile applications, and any related services (collectively, the
                “Platform”). By accessing or using Mosmos, you agree to these Terms.
            If you do not agree, please discontinue use of the
                Platform.
         
        
            
            1. Definitions
            “Mosmos Marketplace” refers to our online platform where customers
                can browse, purchase,
                and pay for products from partner sellers.
            “Mosmos Business” refers to our service where customers are
                introduced by or transact
                directly through our partner stores, either in-store or online.
            “We”, “Us”, “Our” refer to Asenatech Limited.
            “You”, “Your”, “User”, “Customer” refer to any person accessing or
                using Mosmos.
        
        
            2. Eligibility
            You must be at least 18 years old or have legal capacity to enter into a binding
                contract. By using
                Mosmos, you confirm that all information you provide is true, accurate, and up to date.
        
        
            3. Use of the Platform
            You agree to use Mosmos only for lawful purposes and in accordance with these Terms.
                You must not:
            
            We reserve the right to suspend or terminate your access if you breach these Terms.
            
        
        
            4. Pricing and Payments
            For All Customers
            
                - All prices displayed on Mosmos are subject to change without prior notice.
- Prices are not reserved or fixed until full payment has been successfully
                    completed.
- Payments must be made through the approved channels provided on the Platform.
                
For Mosmos Business Customers
            If you are transacting through a Mosmos Business partner (in-store or online), the
                same pricing and
                payment rules apply. Any payment schedules, partial payments, or instalments agreed upon with a partner
                must still comply with these Terms.
        
        
            5. Order Cancellations and Refunds
            For Marketplace and Business Customers
            
                - All product cancellations are subject to a 3% cancellation
                        fee, deducted from the
                    total amount paid.
- Prices may change at any time; Mosmos does not guarantee price stability during
                    a payment period.
                
- Refunds are processed within 24 working hours (Monday–Friday,
                    excluding public
                    holidays) from the time of approval.
- Refunds will be made to the original payment method used.
- If a refund delay occurs due to third-party banking or payment system issues,
                    Mosmos will notify you
                    and follow up promptly.
6. Delivery, Collection, and Ownership
            Ownership of a product passes to you once payment is completed in full and the item
                is collected or
                delivered. Delivery timelines are estimates and may vary depending on supplier or location. Mosmos is
                not responsible for delays caused by third-party suppliers, courier services, or unforeseen
                circumstances.
        
        
            7. Data Protection and Privacy
            We take data privacy seriously. Personal information collected through Mosmos is
                processed in accordance
                with our Privacy Policy and the Kenya Data Protection Act, 2019. By using Mosmos, you consent to such
                processing and warrant that all data provided is accurate.
        
        
            8. Intellectual Property
            All content, trademarks, graphics, software, and designs on the Platform are owned
                or licensed by
                Asenatech Limited. You may not copy, reproduce, modify, or distribute any part of the Platform without
                our prior written consent.
        
        
            9. Limitation of Liability
            To the maximum extent permitted by law:
            
                - Mosmos and Asenatech Limited are not liable for indirect, incidental, or
                    consequential losses.
- We are not responsible for product defects, shipping delays, or errors
                    attributable to partner
                    vendors or third parties.
- Our total liability for any claim arising out of your use of the Platform shall
                    not exceed the total
                    amount paid by you for the specific transaction involved.
10. Termination and Suspension
            We may suspend or terminate your account or access to the Platform if:
            
                - You breach these Terms.
- Required by law or a regulatory authority.
- Fraudulent or suspicious activity is detected.
Upon termination, any outstanding payments or obligations remain enforceable.
        
        
            11. Governing Law and Dispute Resolution
            These Terms are governed by the laws of the Republic of Kenya. Any disputes shall
                first be resolved
                amicably. If unresolved, disputes shall be submitted to the courts of Kenya, which shall have exclusive
                jurisdiction.
        
        
            12. Amendments
            Asenatech Limited reserves the right to modify or update these Terms at any time.
                Updated versions will
                be posted on the Mosmos website with the date of the latest revision. Continued use of the Platform
                after changes constitutes acceptance of the new Terms.
